In an effort to make policy consistent with practice as well as the INA, the DOS announced that, effective February 10, 2014 it has removed the petition requirement for citizens of Mexico applying for nonimmigrant visa classification as NAFTA professionals. The Department of Homeland Security made a similar update to its regulations over ten years ago. The discord between DOS and DHS interpretation of the petition requirement led to ambiguity and confusion for Mexican citizens wishing to come to the U.S. with the TN visa Classification. We have found, in practice, that consuls have acted in a manner conforming to the DHS interpretation. Therefore, this amendment effectively memorializes this change in practice and, while it may help alleviate any future confusion for DOS officials, it should not have any noticeable impact for TN applicants.
